How can you prepare for stricter enforcement of the DBA law?

On Thursday, October 17, the webinar “Future-proof self-employment” took place, in which independent professionals were informed about the latest developments in laws and regulations surrounding the hiring of independent professionals. Experts from HeadFirst Group, including Sem Overduin and Luuk van Maanen, discussed the expected changes and how independent professionals can prepare for them. 

We offer zp'ers support in navigating complex legislation and help to meet the requirements for self-employment. We like to reassure you: working independently remains possible, but it is important to look critically at your assignments and take timely steps to avoid risks.

We give you a few tips:

  • Work with a Contract Agreement including an assignment description
  • Make sure you use a clear Assignment Agreement with a clear assignment description that supports both the assignment and your entrepreneurship. This prevents discussions about false self-employment. Make sure that the agreements are complied with in practice and meet the tax requirements.
  • Behave like an entrepreneur | Assignments no longer than 2 years, multiple clients, independence in performing your work and/or bearing commercial risk are important pillars to show your entrepreneurship. Having your own website, making acquisitions and investing in your own resources and knowledge emphasize your position as self-employed.
  • Avoid leadership and authority | It is crucial that you determine how you perform work. Consult with your client to make it clear that you are not working under direction or supervision as employees do.
  • Keep your records in order | Have well-maintained records that show that you are operating independently. Consider correct invoicing, maintained agreements, and proof that you are working on your own account and at your own risk.
  • Stay on top of regulations | Legislation surrounding independent professionals is constantly changing. Follow the developments surrounding the bill 'Verduidelijking Beoordeling Arbeidsrelaties' and respond to changes in time.
  • Seek professional advice | If you are in doubt about your position, it is wise to seek professional advice. With the right knowledge and guidance, you can ensure that you are compliant.

Should the assignment really not be possible as an independent professional, various alternatives are possible. We advise you on a possible risk profile and help you make the right choices. In that case, make sure you have insight into which form of contract or cooperation best suits your situation before December 31, 2024.
